Problem Properties
Problem properties include derelict buildings, occupied buildings that are in a state of disrepair, rental dwellings that are sub-standard, and sites of questionable activity.
Derelict Buildings
A derelict building is vacant and in a state of disrepair. Derelict properties are dealt with under the Safety Codes Act. Derelict buildings may be repaired to meet health and safety standards or they may be torn down.
Nuisance Properties
Nuisance properties are occupied buildings that are in a state of disrepair or sub-standard rental dwellings.
Characteristics of a nuisance property may include:
- At least 25% of the exterior of the building is in disrepair.
- Walks aren't shovelled or are blocked by overgrown trees or shrubs.
- Overgrown grass, weeds, trees or bushes.
- Wrecked or dismantled vehicles.
- Untidy garbage storage locations.
- Untidy and unsightly property.
Three step process for dealing with a nuisance property:
Step 1: A municipal enforcement officer issues a warning, ensuring the person understands the problem and how to correct it. The person has 14 days to address the problem.
Step 2: If the person responsible does not comply within the timeline initially agreed upon, the enforcement officer issues a formal, written directive. This written directive must outline the problem and how it needs to be corrected. The person has 14 days to comply with the directive.
Step 3: If the person responsible does not comply with the formal written directive, a fine may be issued. The amount of the fine on first infraction is $300, and subsequent infractions are $600.
