Court of Queen’s Bench Dismisses Lucy Lawsuit

The Court of Queen’s Bench has ruled in favour of the City of Edmonton and dismissed the legal action brought against the City by PETA and Zoocheck regarding Lucy, the 35 year-old Asian elephant at the Edmonton Valley Zoo. The judge dismissed the case, stating it constituted an abuse of the court’s process.
“We are very pleased with Chief Justice Rooke’s decision to dismiss the legal action,” said Steven Phipps, City Solicitor. “The Edmonton Valley Zoo takes excellent care of Lucy, and they strive to exceed all applicable regulatory and legislative standards.”
A notice to sue the City was filed on February 1, 2010, on behalf of People for the Ethical Treatment of Animals (PETA), Zoocheck Canada and Tove Reece, a Sherwood Park animal rights activist.
“The City of Edmonton and the Edmonton Valley Zoo continue to make decisions in the best interest of Lucy,” said Phipps. The City is currently implementing the recommendations of a report done by Dr. James Oosterhuis, a third-party specialist, which includes an updated treatment plan.
